Burlington Store / North Hollywood / Shooting Incident / December 23, 2021 / Valentina Orellana-Peralta / Body Camera Footage / 911 Calls / Radio Transmissions / Los Angeles Police Department Release

MOTION-- On December 23, 2021, the Los Angeles Police Department responded to 911 calls for
service at a Burlington store in North Hollywood. The calls ranged from requests to calm a
violent unruly customer to reports that there was an active shooter on the scene.

As has been documented by the released video footage of the police response, officers
arrived to find a man having just assaulted a Burlington customer with a bike lock. Upon
discovering the victim on the ground covered in blood and the suspect, Daniel Elena-Lopez,
one of the officers opened fire on the suspect. The suspect was struck and died of his
injuries. Tragically, at least one round passed through a wall to a dressing room, striking
and killing 14-year-old Valentina Orellana-Peralta.

The tragedy of this incident cannot be overstated. The investigation into the shooting
continues, and the Council, along with the Police Commission and the Chief of Police, must
do everything within its power to ensure that the City responds appropriately to that
investigation.

The circumstances of this shooting serve as a reminder that when a person calls 911 to
report violence, the police are prepared to respond with force to counter that violence. All
of society is grappling with the question of how and when force should be used in
particular circumstances. The City has already begun to pursue an alternative means of
emergency response that has a "force-as-a-last-resort" approach to volatile encounters
with members of the public, and significant policy discussions are continuing about how
best to address violent crime and to reduce risks associated with police use of force.
As the city grieves over this horrendous tragedy, it is imperative that the Council and the
public learn all of the facts about this incident and how the deaths at the Burlington store
could have been avoided.

I THEREFORE MOVE that the Council INSTRUCT the Los Angeles Police Department to
release to the public any unreleased body camera footage, 911 calls, radio transmissions
and other recordings relating to the December 23, 2021 incident, unedited, immediately.

I FURTHER MOVE that the Council INSTRUCT the Los Angeles Police Department to report
on the status of (i) the internal investigation of the December 23 incident, including the
anticipated time frame for each step in the process, and (ii) the LAPD’s cooperation with
the investigation of the incident by the California Attorney General's office and any other
investigative agencies.

I FURTHER MOVE that the Council INSTRUCT the Los Angeles Police Department to report
to the Council on the following:

1) How a report of an active shooter is verified, and how appropriate tactics are
decided upon when such a report is received;
2) The LAPD's policies and practices for pursuing a suspect believed to be an active
shooter or otherwise violent in a contained area where victims and bystanders are
or may be present;
3] The LAPD's policies and practices for protecting victims and bystanders from a
suspect believed to be an active shooter or otherwise violent;
4] The LAPD's policies and practices for reducing the risk to victims and bystanders
from an officer's discharge of weapons;
5} The LAPD's policies and practices for the use of rifles in a short-range encounter
with a violent person when victims or bystanders may be present, and when less lethal alternatives may be more appropriate; and
6) Any changes that have been made in the LAPD's policies and practices in the areas
discussed above, or in the training related to those policies and practices, as a result
of previous use of firearms in situations where victims or bystanders were at risk of
being hit.

1 FURTHER MOVE that the Council INSTRUCT the Chief Legislative Analyst to compile a
report on the best practices utilized by other large police departments for reducing the use
of lethal force, and for protecting victims and bystanders from risk when such force is used.
